A California judge has indicated that she will dismiss a child abuse lawsuit filed by the two lead actors in the 1968 adaptation of Romeo and Juliet. Last December, Olivia Hussey, and Leonard Whiting, who were teenagers when Franco Zeffirelli’s Oscar-winning film was being made, accused Paramount of se*ual exploitation over a n*de scene they claimed was forced upon them after they were told it wouldn’t happen.
This week, Judge Alison Mackenzie suggested in a tentative ruling that she would side with the studio, rejecting the claim that the film depicted child abuse while stating that the plaintiffs had not correctly followed the rules of California law that allowed for a temporary suspension of the statute of limitations over abuse claims.

The actors, who were both under 18 then, are reportedly planning to appeal and file a separate lawsuit based on the film’s recent Criterion DVD release, which would be unaffected by the statute of limitations. As the guardians suggested, “Children cannot consent to use these images,” the pair’s lawyer Solomon Gressen said. “They’re profiting off these images without consent.”
He described them as “very young, naive children in the 1960s who had no understanding of what was about to hit them.”
